These terms govern your use of this website and any enquiry, quote or preliminary discussion you have with Coppins Building And Construction (“CBAC”, “we”, “us”). Formal building work is governed by a separate written building contract signed by both parties.

Coppins Building And Construction is based in Whyalla, South Australia, and operates as a licensed builder under the South Australian Building Work Contractors Act 1995. We are a member of the Housing Industry Association (HIA) and carry $1,000,000 Builders Indemnity Insurance, along with public liability and workers compensation cover as required by law.

Quotes are valid for 30 days from the date issued unless stated otherwise. A quote is an offer to perform the scope of works described in it; it is not a contract. Variations to scope, materials, site conditions, or regulatory requirements after acceptance may change the price and programme, and will be documented in writing.

For domestic building work in South Australia valued over $12,000 we use a written building contract (typically an HIA contract) that complies with the Building Work Contractors Act 1995 (SA) and the Australian Consumer Law. The contract sets out scope, price, progress payments, programme, variations, defects liability, dispute resolution and warranty obligations. You have a 5 business day cooling-off period for in-scope domestic building work contracts.

Under section 32 of the Building Work Contractors Act 1995 (SA), statutory warranties apply to domestic building work, including that the work will be performed in a proper and workmanlike manner, with materials that are good and suitable, in accordance with plans and specifications, in compliance with all laws, and that the building will be reasonably fit for occupation. These warranties cannot be excluded.

Where required by law (generally domestic building work over $12,000), we hold Builders Indemnity Insurance covering you against non-completion, loss of deposit, and defective work where the builder dies, disappears or becomes insolvent. A certificate is provided before any deposit is paid.

For insurance-related repairs or rebuilds, our scope, programme and payment are typically governed by your insurer’s scope of works and authorisation. You remain the homeowner and our client; we work to your insurer’s approved scope and report variations through the proper channels.

Once we mobilise on site, the site becomes a workplace governed by the Work Health and Safety Act 2012 (SA). You agree to keep non-authorised people (including pets and children) clear of active work areas, to follow our site rules, and to give us reasonable access to perform the works.

Payment terms (deposit, progress claims, final payment) are set out in your signed building contract. Invoices are payable within 7 days unless the contract states otherwise. Overdue amounts may attract suspension of works as permitted by the contract and applicable law.

We rectify defects notified within the defects liability period set out in your contract, in addition to statutory warranties. Notify us in writing and we will arrange inspection and rectification within a reasonable time.

To the maximum extent permitted by law, our liability for any claim arising from your use of this website is limited to the resupply of the relevant information. Nothing in these terms limits any rights you have under the Australian Consumer Law or statutory warranties.

We aim to resolve any concern directly and promptly. If we cannot, disputes relating to building work follow the dispute resolution process in your contract and the South Australian Office of Consumer and Business Services (CBS). These terms are governed by the laws of South Australia.
